These terms apply to your use of the Near Nature app for iOS and this website (together, “Near Nature”). By downloading, accessing, or using Near Nature, you agree to these terms. If you do not agree, please do not use the app or website.

About Near Nature

Near Nature is an educational app for learning to recognize local wildlife. Features may change over time, and we do not guarantee that any particular feature or content will always be available.

Your account

Some features require an account. You are responsible for providing accurate information, keeping your sign-in details secure, and all activity under your account. Let us know promptly if you believe your account has been used without permission. You can delete your account at any time from within the app or by contacting us.

Educational use

Content in the app is provided for general learning and may be incomplete or inaccurate. Illustrations and descriptions are not definitive identification guides. Do not rely on Near Nature to decide whether an animal is safe to approach, handle, or consume, or to make medical or other safety-critical decisions.

Respect wildlife

Observe wildlife from a safe distance, respect habitats and private property, and follow local rules. Do not disturb, feed, capture, or handle wildlife based on information in Near Nature. Stay aware of your surroundings while using the app outdoors.

Acceptable use

You may use Near Nature for personal, noncommercial learning. You must not misuse it, attempt unauthorized access to the app, its servers, or other users’ accounts, interfere with its operation, reverse engineer it except where the law allows, or use it unlawfully.

Content and ownership

The Near Nature name, app, original text, illustrations, and design belong to their respective owners. We grant you a limited, personal, non-transferable, revocable license to use the app on Apple devices you own or control, as permitted by the Apple Media Services Terms. These terms do not transfer ownership or grant permission to use our branding.

Apple

These terms are between you and Near Nature, not Apple. Apple is not responsible for the app, its content, maintenance, support, or any claims relating to it. If the app fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you are not located in a country subject to U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.

Suspension and termination

We may suspend or end access to Near Nature, including your account, if you break these terms or if we need to protect the app, other users, or the public. You may stop using Near Nature and delete your account at any time.

Availability and responsibility

We provide Near Nature as available and do not promise uninterrupted access or error-free content. To the extent permitted by applicable law, we disclaim warranties and liability for losses resulting from use of the app or website. Nothing in these terms excludes rights or liabilities that cannot legally be excluded.
